Litigation Experience

Roger was lead counsel in each matter listed on the firm's Reported Decisions page. His trial experience includes numerous Provincial Court and Small Claims trials and a six-day Ontario Superior Court of Justice trial involving defamation and civil sexual battery for which a decision is pending.

He has appeared on numerous special applications and appeals, and regularly appears on the Court of King's Bench of Alberta Commercial List in insolvency matters. He acts for plaintiffs and defendants, creditors and debtors, and appellants and respondents.

Roger J. Baker was trial counsel for the plaintiff societies in Authentic Southside Taekwon-Do Club (Tien Lung Taekwon Do Club Edmonton South) v Taylor, 2026 ABKB 470, a nine-day defamation trial before the Alberta Court of King's Bench. The action arose from a CTV Consumer Watch television report that was also published through CTV's website and its national Facebook page. The Court held that one of the meanings conveyed by the report was false and defamatory, rejected the applicable defences for that meaning, and awarded the plaintiffs $250,000 in general damages plus prejudgment interest. The plaintiffs have appealed portions of the liability findings and damages assessment, seeking broader liability findings and greater relief.

Class Actions and Multijurisdictional Proceedings

Roger acts as Alberta counsel alongside KND Complex Litigation for plaintiffs in proposed securities class proceedings involving Exro Technologies Inc. The proceedings include claims in the Alberta Court of King's Bench and related proceedings in the Supreme Court of British Columbia.

Baker Law Firm was retained as co-counsel while Exro Technologies Inc. was being petitioned into receivership and, later, bankruptcy. The class claims became intertwined in an Alberta commercial insolvency proceeding, which necessarily included a stay of proceedings. Roger's experience as insolvency counsel, including his knowledge of the processes and procedures on the Court of King's Bench of Alberta Commercial List, made Baker Law Firm a top choice when the class sought new local counsel of record, replacing a highly respected litigation firm.
